TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or executing deathBoard_ (the "Software"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the terms and conditions set forth herein, you must immediately halt execution, cease all use, and permanently delete all copies of the Software from your hardware.

2. MERCHANT OF RECORD (PADDLE)

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

By purchasing the Software, you acknowledge and agree that Paddle provides all customer service inquiries and handles returns, billing, and tax compliance related to your purchase. Your payment relationship is legally with Paddle.com, subject to the Paddle Checkout Buyer Terms.

3. LICENSE GRANT & RESTRICTIONS

deathBoard_ is licensed, not sold. Subject to your compliance with these Terms and payment of applicable fees, we grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software on macOS devices that you personally own or control, strictly in accordance with your purchased license tier.

You strictly agree NOT to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software.
  • Circumvent, bypass, or disable any digital rights management (DRM), license verification systems, or trial-period time gates.
  • Intercept, manipulate, or modify the background agent's memory footprint, Carbon API keyboard hooks, or clipboard polling mechanisms.
  • Share, distribute, rent, lease, or resell your license key or any portion of the Software.
  • Use the Software for any illegal, malicious, or unauthorized purpose.

4. APPLE EXCLUSION

You acknowledge and agree that these Terms are solely between you and the developers of deathBoard_, and not with Apple Inc. We, not Apple, are solely responsible for the Software and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Software.

5. UPDATES & PERPETUAL FALLBACK

Your initial purchase of the Software grants you a perpetual license to the current major version, including 12 months of free software updates from the date of purchase.

We guarantee that the version of the Software you purchase will receive necessary compatibility updates to remain functional on the latest stable macOS version available at the exact time of your purchase. We do not guarantee indefinite compatibility with future major macOS releases beyond your 12-month update window unless you renew your update license.

6. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the Software, including but not limited to all copyrights, patents, trademarks, trade secrets, interface design, branding, and proprietary assets, remain the exclusive property of the developers of deathBoard_. These Terms do not grant you any rights to use our trademarks or brand assets.

7. DISCLAIMER OF WARRANTIES (AS-IS)

THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

While deathBoard_ is engineered for maximum performance, we do not warrant that the Software will be completely uninterrupted, completely secure, or error-free. We do not guarantee that the Software will safely handle maliciously crafted clipboard payloads without fault. You assume all risks associated with deploying high-frequency background processing utilities on your system.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPERS OF deathBoard_, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

This includes, without limitation, damages for loss of profits, goodwill, use, data loss, system failure, security breaches, or other intangible losses arising out of or relating to the use of, or inability to use, the Software. Under no circumstances will we be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to the Software or your clipboard data.

9. REFUND POLICY

Due to the nature of digital software and the availability of a fully-featured 14-day free trial, all sales are considered final. By completing your purchase and initiating the download of the Software, you expressly consent to immediate performance of the contract and acknowledge that you lose any statutory right of withdrawal or refund (including those under EU/UK consumer protection laws). Refunds are processed solely at our discretion, as managed by our Merchant of Record, Paddle.com.

10. TERMINATION

We reserve the right to instantly revoke your license, terminate your access, and refuse future service without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms (e.g., license sharing or piracy attempts). Upon termination, your right to use the Software will immediately cease.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by a recognized arbitration provider, rather than in court. You agree to resolve disputes only on an individual basis and explicitly waive any right to bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
